Abstract. The principle of subsidiarity represents an effective organizational model of human society, wherein a higher level should engage in addressing a particular matter only when the lower level lacks the competence to do so. One of the areas in which the principle of subsidiarity finds significant application is constitutional adjudication, particularly in proceedings concerning individual constitutional complaints. Although interpretations of the subsidiarity principle in this context vary, most scholars agree that one of its key manifestations is the requirement that a complainant must exhaust all available remedies before lodging a constitutional complaint. A problem arises, however, when a particular remedy mechanism is not established by law, but rather by an internal instruction that lacks general binding force and public accessibility. This is the case with the request for review of the conduct of a prosecutor or police officer, which is governed by an instruction of the Prosecutor General on the procedure to be followed by prosecutors in handling requests for the review of legality in pre-trial criminal proceedings. In this context, the author analyzes the development of the Constitutional Court of the Slovak Republic’s practice—which has thus far been inconsistent—regarding the necessity of exhausting such a request before filing a constitutional complaint. The author also reflects on the possibilities for achieving an optimal resolution to this issue, both in the current situation and in future developments.
