The content of the presented text will be devoted to three key protective measures, namely protective treatment, protective supervision and detention. The article will provide an analysis of domestic legislation in relation to the aforementioned institutions and, on this basis, will evaluate whether the de lege lata legislation may present certain problems pro futuro. Based on a comparison with the legislation of the Czech Republic, it will provide the reader with a foreign perspective on the aforementioned institutions. The author believes that it is protective treatment and detention that predict the protection of society to the greatest extent in relation to one of the weakest links in our society, namely to people who, under the influence of a mental disorder, have committed an illegal act. The protective measure, protective supervision, completes the imaginary protection of society, namely in relation to offenders who exhibit a certain anomaly in their recidivist lives.
